Life in the Fast Lane: College Savings Bank

College Savings Bank took its case all the way to the

Supreme Court and lost. It had sued the state of Florida for infringing

its patent on CollegeSure CDs, a financial program that uses certificates

of deposit to save for and prepay college tuition. Florida offered

a similar savings plan. But in two 5-4 rulings, the Supreme Court

ruled against the Vaughn Drive-based bank (https://www.collegesavings.com).

In this victory for states rights the majority opinion — that

individuals and companies cannot sue states to enforce a federal right,

such as a patent — was written by Chief Justice William Rehnquist,

joined by Justices Sandra Day O’Connor, Antonin Scalia, Anthony Kennedy,

and Clarence Thomas. In the minority, arguing that “no man is

above the law,” and that this includes state agencies, were Justices

John Paul Stevens, David Souter, Ruth Bader Ginsburg, and Stephen

Breyer.
